HAD & Co Successfully Wins Appeal Against Bolton Council: A Landmark Decision for HMO Development.
HAD & Co has successfully overturned Bolton Council's refusal to allow an increase in bedrooms at a large town center House in Multiple Occupation (HMO) on Oxford Street. This appeal marks a significant victory, with the potential to set precedence for future HMO developments in the region.
Initially, Bolton Council denied an application from our client, to expand from a 12-bed to a 15-bed HMO, citing concerns over amenity levels and access to communal facilities. However, following a thorough investigation, Planning Inspector David Cross found that the evidence did not support the council's position.
Mr. Cross highlighted that the proposed layout offered "convenient access" to shared kitchen and dining areas, contrary to the council's claims of convoluted routes. He emphasized that the design guidelines for separation distances while generally applicable are merely advisory and should accommodate the unique context of HMO settings.
Moreover, while the separation distance between bedroom windows and neighboring buildings fell short of the recommended standard, Mr. Cross determined that the outlook and natural light provided were adequate for resident welfare. He noted that residents would have access to alternative shared and private facilities, reinforcing the notion that the development would meet the needs of future occupants without detrimental impact.
Given the sustainable location of the HMO in a vibrant town center, coupled with access to parks and public spaces, the Inspector ruled that the proposal would not lead to increased crime or anti-social behavior. This enlightening decision underscores the importance of understanding the distinct characteristics of HMO living and allows for greater flexibility in planning assessments.
