Lain kali tak payah bertekak dengan Developer klu Developer berdegil tak nak repair Defect rumah kita, buat sakit anak tekak jer. Klu rumah kita masih under Defect Liability Period (DLP) lagi mudah kita nak ambil tindakan.

Klu mereka tak nak repair defect. Buat ikut step ni.
Step 1. Hantar formal letter ke developer dan cc ke peguam S&P kita. hantar guna pos berdaftar (supaya ada record)
Step 2. Tiada tindakan after 30 hari, hantar surat kedua untuk peringatan dan akan report ke Tribunal. Surat mesti cc ke peguam S&P.
Step 3. Tiada tindakan juga selepas 14 hari, bawak 2 surat ni dan pergi ke Tribunal. Tribunal memang akan memihak pada Pembeli.

Nota:

1. Kenapa kene cc ke peguam S&P kita?
Sebab duit loan dari Bank pinjaman kita, peguam kita yang control. Kebiasaan nya peguam & bank tak kan lepas kan duit 100%, mereka hanya release 95% sahaja dan akan simpan 5% retention sum.

Contractor mesti kene settlekan semua kecacatan baru boleh terima 5% retention sum after DLP.

2. Bila peguam dan bank akan release 5% retention sum?
Bank akan release retention sum after end defects liability period (DLP). DLP adalah 24 bulan.

Tapi developer pun cuba tipu saya, mengatakan DLP just 3 bulan masa ambil kunci, tapi saya pun dari industry pembinaan, so memang tahu 24 bulan. Saya pun ada rakan-rakan dalam industry ni, mudah saya nak double confirm dengan Arkitek, Quantity Surveyor dan Contractor lain

3. Apa guna Bank tahan 5% retention sum tu?
Apabila jadi klu contractor berdegil tak nak repair defect tu masa DLP period. Pemilik boleh baiki sendiri kecacatan tu dan claim balik duit repair tu dengan syarat kita dah hantar surat ke developer seperti step2 di atas.

Developer pun boleh baiki dan deduct dari amount 5% retention sump.

4. Apa jadi keretakan selepas tempoh DLP.
Ada sesetengah kerosakan yang cover selepas DLP period, antara nya keretakan dinding. Masih ada Warranty bangunan, ni saya tak pasti berapa lama,

So apa tindakan yang perlu kita lakukan. Hantar surat ke Developer, dah buat 2nd step masih takde respond dari Developer, pergi Tribunal buat report.

Kawan saya beli rumah subsale kat AntaraGhapi, rumah retak (Major), sebelum masuk rumah dia basuh lantai tapi air boleh meresap ke rumah sebelah. Report ke PKNS, mereka memang baiki, ambik masa sebulan untuk buat strengthening structure balik. Rumah tersebut ada mendapan, tu yang menyebabkan rumah tu rosak teruk.

Cermin di balkoni saya tiba-tiba pecah.

Saya isi form defect kat pemaju tapi alasan pemaju Cermin di balkoni tu external (luar rumah) so tu bukan under defect yang contractor perlu baiki. Pemilik kene baiki sendiri. Contractor hanya baiki dalam rumah sahaja.

Kira mereka berdegil tak nak baiki cermin di balik balkoni saya. Hurm, tak perr.

Saya just buat first step. Hantar surat formal, cc ke peguam saya dan hantar by pos berdaftar. Saya pun ada hantar by hand sebab takut pos berdaftar lambat.

Tapi klu guna pos berdaftar lagi kukuh sebagai bukti nak bawak ke mahkamah tribunal.

Hari ketiga tu, wakil developer dan pihak contractor datang kerumah saya untuk periksa dan bersetuju ganti semula.

Leaking dalam bilik air saya betul2 di atas mirror, menyebabkan mirror jadi tompok-tompok hitam.

Mirror tu saya built in, saya tambah selepas dapat kunci.

Saya dah check dengan rakan saya merupakan Quantity Surveyor, mirror saya rosak disebab kecacatan bangunan memang tanggung jawab contractor kene tukar baru.

Contractor tak nak layan, so saya buat sampai second step. Lepas tu contractor sendiri cari kita, mungkin disebabkan 5% retention sum tu peguam kita tahan.

So Contractor kene dapatkan release letter dari pemilik baru peguam kita lepaskan retention sum tu.

Tak sempat pun saya report ke tribunal
