Pertaining to asphalt material, the contractor does not express or imply any type of warranty or guarantee of material used, with the understanding that the contractor does not make or manufacture the asphalt paving material. We also cannot guarantee that the paved surfaces will remain free from cracks due to
normal freeze/thaw and conditions of extreme temperatures, nor do we guarantee that the paved surface will remain free of low cracks resulting in small pools of water, or from vegetation penetrating the paved surfaces. Once having gone over the contract that will be provided, the property owner is required to sign. It will state that the property owner has read in full all terms and conditions of the contract, agrees in full, and thereby accepts all terms and conditions of the contract and accordingly affixes the property owner's signature to bind all terms and conditions set forth herein. The property owner understands and agrees that the contractor shall not be liable for any storms, earthquakes, floods, wind, rain, war, riots, vegetation growth or any act of God that would delay completion of the contractor's obligation under this contract. If the property owner breaches any of its obligations under this agreement, the contractor will have all remedies available under law and equity, including reasonable attorney's fees and court costs to enforce this agreement. Interest shall be assessed and accumulated at the rate of 1.5% monthly on any unpaid balance under this agreement.
