Durban - Durban - The Constitutional Court has found former president Jacob Zuma guilty of contempt of court and sentenced him to 15 months imprisonment.

Justice Sisi Khampepe read out the judgment on Tuesday, which found that Zuma was fully aware of the consequences of his actions and willfully defied the court’s order to appear before the Zondo Commission.

“The majority holds that a coercive order which uses the threat of imprisonment to ensure compliance will be both futile and inappropriate,” Khampepe said.

She said there was “no sound basis” for Zuma to claim that he was being unfairly treated.

“The majority finds itself with no choice but to find that this kind of incalcitrance cannot be tolerated,” Khampepe read.

She pointed out that Zuma’s case was exceptional because of his position as a former president as well as his criticism of the judiciary.

The ConCourt justices strongly condemned Zuma’s “outlandish statements” and found that the only reasonable sentence was an unsuspended sentence of 15 months imprisonment.

The ConCourt ruled that Zuma must hand himself over to police at either Nkandla police station or Johannesburg Central within 5 calendar days to commence serving his sentence.

Meanwhile, Zuma’s supporters secured his Nkandla home ahead of Tuesday's judgment. The MKMVA (Umkhonto we Sizwe Military Veterans Association) battalion that has been stationed outside the rural home since late March was in high spirits.

They were heard singing Struggle songs from the tent they use as their base. Some of them were seen outside parading.

Zuma’s most vocal son, Edward Zuma, did not say anything about the pending sentencing.

Zuma’s run-in with the court started in December last year when the Zondo Commission, which is probing allegations of corruption during his nine-year rule, approached the court to ask it to compel him to appear and answer all questions posed to him.

The order was granted but Zuma decided to defy the court, alleging that the commission and the court were victimising him through exceptional and harsh treatment and that both institutions were politicising the law to his detriment.

The secretary of the commission, Professor Itumeleng Mosala, then asked the court to penalise him with contempt of court. On the same day, Zuma issued another long statement and said that he had taken a political position not to take part in the matter because the judiciary was engaged in political battles against him.

“It is no longer my attendance that they seek, but they have joined the political campaign to destroy me. It also reveals that this was always the commission’s mandate,” Zuma said at the time.

He said that Deputy Chief Justice Raymond Zondo who chairs the commission was “exploiting his proximity to the Constitutional Court to protect and advance his interests as chairperson of the commission”.

When the matter was heard on March 25 this year, advocate Tembeka Ngcukayitobi, acting on behalf of the commission, asked the court to hand down a two-year sentence, arguing that Zuma had made serious allegations against the judiciary without any evidence to back them up.

" Basically he’s using the language of daring the court, 'I'm not afraid to go to prison. Even prior to coming to the court in December 2020, the commission had tried to use its coercive powers. I know that there is criticism in the judgement, but he was given leeway that would not ordinarily be given to witnesses. But the fact is the coercive powers were tried, they didn’t work. The is no scope for coercive powers, the only scope that remains now is imprisonment. Utterances that Mr Zuma has made are malicious utterances. He is also acting without any facts – Mr Zuma completely disregards the evidence,” Ngcukayitobi told the court in March when arguing why Zuma should be jailed.

*WHERE ARE OUR STOLEN AND HIJACKED VEHICLES GOING TO?*

The Specialist Section, Durban Cluster announces the conviction of Wind Motors and South x South 29 (PTY) Ltd – both represented by Sanj Gounden.
Wind Motors is a well-known business in the Durban area, run by brothers Sanj and Sagren Gounden. Its primary business is dealing in second-hand motor vehicle parts, building and modifying vehicles for the purposes of sale.

South x South 29 (PTY) Ltd is an export company with husband and wife - Sanj Gounden and Kershnee Gounden as the Directors.

In December 2018 a container was packed at Wind Motors, Parlock, and transported to the Durban Harbour for shipment to Mauritius. Police received information that the container contained illicit goods. The container was stopped. The search yielded that the multiple motor vehicle parts were linked to theft, robbery and fraud cases from the Durban area.

Sanj Gounden, representing South x South, accepted responsibility for these goods – and pleaded guilty to Receiving Stolen Property (Count 1)

During the course of ensuing investigation, it was discovered that South x South also received into its possession a red Hyundai Accent from a business associate – which was discovered to have been stolen the year before. This 2nd count was also pleaded to (s37)

Further investigation into the business also yielded that Wind Motors, being a builder and modifier of vehicles, and selling same, was conducting business without registering with the Department of Transport as a Builder (Count 3)

The Accused was sentenced to a fine of R280 000-00 half suspended on the s37 charges and R10 000-00 for Failing to Register as a MV Builder.

Specialist Prosecutor Mr Vishalan Moodley guided a marathon investigation of giant proportion, and crossed many hurdles in order to achieve these successful convictions. Well done also to the TICIU Investigation Team headed by W/O SH Ngcobo, Cst Nigel Naicker, Sgt Ngube, Cst Maome and Cst Mthuli – supported unconditionally by Brigadier A Gopaul and Colonel Ndlazi.

The investigation was also greatly supported by the South African Insurance Crime Bureau (SAICB) through Mr HL (Lieb) Liebenberg and Mr Pine Pienaar, for their limitless guidance and insights during the course of the investigation. Their unconditional support to the Investigation contributed greatly to the success of the case.

In respect of the charges relating to the identifying of the container parts, and the building and modifying of the vehicles by Wind Motors, the Prosecution is grateful to W/O J Vermaak of VCIU – Port Shepstone whose investigation and guidance was invaluable in the matter. Officer Vermaak was the glue that held both parts of the investigation together.

In respect of the safekeeping of the parts, we are grateful to W/O Van Der Merwe from the Port Shepstone VSS for the excellent management of the exhibits.

There were many others stakeholders who contributed to the initial investigation: Colonel FAB Deckford, Vic Chitanand, Bugzy Bhagwandeen and Pieter Laubscher of Tracker, Carl Dornbrack of Recoveri, Kevin Pieterson of Veridot, Jurie Roberts and Neil Ryan of Datadot, Neville M**h of RTI, WESBANK and ABSA Bank Investigators, and Kobus Van Staden of Department of Transport-KZN.

We are also grateful to the State Metallurgical Engineers W/O Lwazi Jack and W/O Leshope Choenyane for their excellent investigation in respect of the modification of the vehicles. These investigative capacities are hidden gems in the State Resources that will hold us in good stead in future investigations.

This case sets a precedent warning to the auto-building industry. Stolen and Hijacked motor vehicles are quickly chopped, and disposed off into the spare parts market. There will always be the temptation to buy cheap goods and re-sell them at high profit. This is a warning to spare parts dealers to ensure high levels of ethics and governance in their businesses.

The Failing to Register as a Builder is the first conviction for KwaZulu-Natal, and certainly, sets the precedent in the industry for other unregistered auto body builders, and backyard panelbeaters.

Both were declared dead at the scene.

Durban - Two men found in possession of drugs worth R285 700 are expected to appear in the Chatsworth Magistrate’s Court on Tuesday.

The Durban Metro Police tactical response unit acted on a tip-off that drugs were being delivered by car to a certain home in Chatsworth on Thursday night. Durban Metro police spokesperson Parboo Sewpersad said the car was intercepted and two houses in Chatsworth were searched for drugs. One of the houses was in Bayview, the other in Arena Park.
Two men, aged 28 and 26, were arrested. They were found in possession of 2 932 pieces of rock co***ne with an estimated street value of R146 600.

Police found six moon-shaped pieces of rock co***ne worth an estimated R137 500. Police also found 32 packets of co***ne powder with an estimated street value of R1 600.

The men were detained at Chatsworth SAPS on drug-related charges.

Sewpersad commended what he regarded as a dedicated team for going beyond their call of duty in the arrests and the recovery of the drugs.
