For ALL contracts dated from 1 Jan 2025 - all Vendors (sellers) WILL require an ATO Capital Gains withholding clearance certificate (ATO Clearance Certificate)
Can be up to 28 to obtain
Apply now - can be used for up to 12 months. (See link)
Penalties apply if you don’t have a certificate.
Need further info - check to ATO website or ask your conveyancer, solicitor or tax agent.

Major changes are happening in the Conveyancing space!!

The Recorder of Titles has put in place measures to provide a more robust and secure system to protect one of our most valuable assets - our property titles.

What does this mean for you the consumer? It means that your conveyancer or solicitor will be requesting (amongst other things) evidence of your identity and your right to transact on the property.

These changes bring us closer to the processes currently in place on the β€˜mainland’.

In the background it also means more work your representatives must undertake to comply with the changes.

We thank you for your patience and understanding as those of us working in the industry get across these changes and put measures in place in order to protect you and your property.

On 7 March 2024 improvements to the property conveyancing process in Tasmania came into effect via the issuing of Directions in accordance with the Act.

Thank you to everyone for their patience and understanding during the renovations at our Devonport office.

Our Ulverstone office is now closed and all the fabulous staff have relocated back to the Devonport office.

While there will be some minor finishing off works in the coming weeks all the staff look forward to assisting with your property transactions.

PlanBuild Tasmania allows anyone to enter an address in the portal to see what planning zones and codes apply to their property. A Property Report can be generated which includes maps, details of the planning zone, codes and other information that affect the selected property.
For those properties that fall under the Tasmanian Planning Scheme, PlanBuild Tasmania provides a comprehensive Guided Enquiry service, including identifying planning, building and plumbing rules that may apply to a proposed project.
You will be able to work through a series of questions on your proposed project resulting in information on:
β€’ who to consult (e.g. local council, Heritage Tasmania)
β€’ who can do the work (e.g. a licensed builder)
β€’ what to apply for (e.g. a permit).
After completing an enquiry if you have additional questions or wants to request advice from a council, this can be lodged online using PlanBuild Tasmania.
