Scunthorpe HMO operators? The Council has just issued notice that they will be bringing into force an Article 4 Direction on 26th November 26 removing the right to turn dwellings into small HMOs for up to 6 occupants without the need for planning permission.

Advice. Don’t put in Certificates of Lawfulness for a Proposed Use and don’t buy cheap properties with Certificates of Lawfulness of Proposed Use (CLOPUD) unless you can complete and tenant before November. If you submit a CLOPUD application now I can absolutely guarantee that council will delay issuing consents until you haven’t got time to implement. A CLOPUD will be absolutely worthless post 26th November unless you’ve fully implemented.

My advice is implement C4 now, and if necessary, put in a Certificate of Lawfulness of an EXISTING Use to confirm the small HMO use was implemented prior to the Article 4 date. Acorn have vast experience in assisting HMO operators in Article 4 areas, call us if you need advice.
