Subject: Concerns Regarding Command Paper 1448 and BNO Settlement Pathway
Dear ###,
I am writing as a constituent and British National (Overseas) (BNO) visa holder regarding the Home Office Command Paper 1448, A Fairer Pathway to Settlement, published on 20 November 2025.
While I welcome the continuation of the 5-year settlement route, I am deeply concerned that the proposed Mandatory Requirements (MQs) may apply to all current BNO residents who have not yet obtained Indefinite Leave to Remain (ILR). This creates significant uncertainty for families who have built their lives in the UK in good faith.
I would be grateful if you could raise the following questions with the Home Office and the Home Secretary before the consultation closes on 12 February 2026:
1. Economic Contribution Requirement
* Will the “sustained economic contribution” apply to all adult applicants, including non-working spouses, retirees, and full-time students?
* Will there be retrospective mechanisms for dependants unable to meet thresholds prior to the introduction of these rules?
* Will young adults in full-time education, who were under 18 at the time of visa application, be exempt?
2. Transitional Fairness
* Will existing exemptions—such as the English-language waiver for applicants aged 65 and over—be removed? This may discourage financially independent retirees from remaining in the UK.
* Will the new MQs apply to all current BNO visa holders, including those nearing ILR eligibility under the current rules?
3. Impact on Asylum and Refugee Holders from Hong Kong
* Will individuals granted asylum or refugee status face a 20-year settlement requirement? This appears disproportionate and raises concerns regarding fairness, clarity, and proportionality.
4. English Language Requirement (B1 → B2)
* The BNO route was introduced with a B1 English requirement, which applicants have reasonably relied upon. Raising the standard to B2 without a transition period would undermine legal certainty and disproportionately affect vulnerable groups. Will B1 results remain valid for those nearing ILR eligibility?
