A further update regarding the abandoned flat and scaffolding.

I have today sent an email to building control to ask them to work with me, if possible by giving me any contact details they have for the property owner. I await their reply.

If contact cannot be made I will be shortly instructing my solicitor to start the process of forfeiting the lease. This may take some time but will ultimately bring the property into my control and repairs and refurbishment can then begin.

I remain optimistic that this can be achieved and with the assistance of DCC building control the scaffolding can be removed and the property improved so as to provide a good residential space.

Just following on from last night's meeting.

I have done some further research and although the reverse lease agreements are complex between myself and the missing owner of the flat it would appear that I have right of access in order to undertake repairs.

I will be asking the Council for any contact details they have so that I can inform the owner of this and make an offer to purchase. If contact cannot be made minimum repairs will be undertaken.

At that point I will ask the scaffolding company to remove their property.

There are some legal challenges involved with this and discussions with DDC building control are likely to be challenging so it may still be sometime before the work can be completed.

Apologies for the photo, due to the wind this morning it was difficult to get a good one. I think you all know the building I’m about to refer to. Until now I haven’t commented much on this site due to possible legal proceedings. In fact one previous owner of the flat did try the court process to force me to pay towards their repairs, needless to say they failed.

This situation has now been in a state of limbo for over three years with the various parties unable to move forward. During that time I’ve not had the full use of my part of the building, damage was caused to the exterior when the scaffolding was erected and recently an internal plumbing leak in the flat has caused damage to my shop.

In addition I know you are all tired of the scaffolding and pavement closures and therefore I am proposing that the council, myself and any other available interested parties set up a meeting with the aim of having the work undertaken to, as a minimum, make it safe. I am willing to contribute substantially to this if a legal route for the right of access etc can be found.

Please let me know your thoughts on this and perhaps anyone with a connection to DCC building control could ask them to be involved. Anyone with legal training would also be useful.

The latest we have from our land line supplier is that they are unable to reconnect us using our existing phone number. I have no idea why this should be the case and neither do they although they have made various excuses. We are looking at the options available but it is likely that we will have a new number in the coming weeks.

We now have in stock many new products from several new suppliers, look out for posts over the next few days.
