Not all hope is lost, but in the UK, the Wildlife and Countryside Act 1981 makes it illegal to damage or destroy active nests. Birds typically nest between March and August, so it adds an extra layer of complication that isn't there outside of this timeframe.
Also, depending on the type of tree you want pruned, active growth periods are best avoided to prevent damage.
