MISCONCEPTION ON ARCHITECTURAL DRAWINGS

A common misconception is that architectural drawings are merely sketches and illustrations. That is not true. Architectural drawings are a vital tool to different aspects of a project.

Visualization: Architectural drawings visualize the proposed building in detail. This includes, but is not limited to, perspectives, floor plans, elevations, and sections.

Communication: Complete architectural drawings ensure coordination with different building systems, such as structural, mechanical, electrical, and plumbing, to avoid conflicts during construction.

Compliance: Architectural drawings ensure compliance with building codes, zoning regulations, and other design requirements, which is necessary for permits and approvals.

Quality Control: Architectural drawings serve as a benchmark for quality control, ensuring construction aligns with specifications and standards.

Cost Estimation: Detailed drawings aid in accurate cost estimation by detailing material specifications and quantity.

Documentation: Architectural drawings provide a valuable reference in building maintenance and modifications.

MABUHAY LAHAT NG ARKITEKTONG PILIPINO!

The Supreme Court said ONLY licensed and registered architects, and not civil engineers, may prepare, sign, and seal architectural documents such as plans or drawings, detailed designs, and fire safety documents.

The tribunal made the ruling as it reversed a Court of Appeals decision that had granted the petition of civil engineers and declared void the provisions of the revised implementing rules and regulations of the National Building Code that limited to architects the authority for coming up with the architectural documents.

The Philippine Institute of Civil Engineers, Inc. and Leo Gamolo had said that civil engineers should also be allowed to prepare, sign, and seal the architectural documents as provided for under the Civil Engineering Law, or Republic Act 544, and the National Building Code.

But the SC Second Division, in a March 15, 2023 decision posted on its website on November 9, upheld the validity of the revised IRR, which means only architects may prepare, sign, and seal the architectural documents.

It said the Architecture Act of 2004, or Republic Act 9266, has in effect repealed the contrary provisions of the RA 544.

The language of RA 9266 reveals an intention on the part of the legislature to limit civil engineers’ authority prepare, sign, and seal documents relating to building construction, it said.

“Taking into consideration the irreconcilable conflict between two laws, this Court recognizes that Republic Act No. 9266 has impliedly repealed Republic Act No. 544 insofar as it permits civil engineers to prepare, sign, and seal architectural documents,” it said.

It also said that even if RA 9266 contains a provision stating that this law should not be construed to prevent the practice of any other legally recognized profession, this is a general provision.

The specific provision in RA 9266 that deals with the practice of the architecture would still prevail, it said.

The SC also noted that repeals by implication are frowned upon as a rule.

But when two laws are clearly in conflict with one another, it has no choice but to concede that the earlier law has been impliedly repealed by the later law, it said.

The decision was penned by Senior Associate Justice Marvic Leonen.
