Press Release: Montgomery County Sheriff's Office Responds to Eviction Situation, Takes Individual into Custody

On the morning of May 9, 2024, deputies from the Montgomery County Sheriff's Office arrived at a residence at 501 S. 8th Street in Independence, Kansas, with a court order and writ of assistance to evict Daniel Brault. This order, signed by a Montgomery County judge, required Mr. Brault to vacate the property by the specified date.
When deputies made contact with Mr. Brault at the front door, he reacted by slamming it shut and locking it. Despite attempts to communicate through the window, he refused to exit the residence and comply with law enforcement's orders.
Seeing that Mr. Brault was not willing to cooperate, deputies entered the residence and found that he had barricaded himself in a bedroom. After giving him multiple announcements to come out and surrender, which he ignored, deputies forced open the bedroom door. They deployed a less-lethal Noise Flash Diversionary Device (NFDD) before entering, ensuring that the situation could be resolved with minimal risk.
The deputies successfully entered the bedroom and took Mr. Brault into custody without any injuries. He was transported to the Montgomery County Department of Corrections and booked for interference with law enforcement.
Sheriff Ron Wade commented on the incident: "Our deputies had a lawful court order to carry out this eviction. Generally, we donβt face resistance when serving such orders. However, in this case, the subject chose to barricade himself. I am extremely proud of our deputies for their professionalism and the way they handled the situation, using less-lethal methods to ensure everyone's safety."
The case has been referred to the Montgomery County Attorney's Office for appropriate charges. As always, we remind the public that all suspects are presumed innocent until proven guilty in a court of law.
