On August 6, 2024, Shenandoah Police Department’s Sergeant Mark Brockhoeft and Officer Eric Bauer violated my rights.
I was waiting for a music artist to wake up so we could film a music video. The police responded to a call from a hotel across the street, and I just happened to be walking on the sidewalk nearby when they arrived. The caller’s only description was “two homeless guys.” Despite this vague and discriminatory description, the officers stopped and detained me for over two hours—and even tried to take me to jail. Fortunately, the jail refused to book me because there was no legal reason for my arrest.
During the stop, Sgt. Brockhoeft lied to Officer Bauer, claiming I was seen on security footage. But his own bodycam footage proves this wasn’t true. Still, they continued trying to jail me. Before that, the officers nearly broke my finger trying to forcibly fingerprint me on the side of the road—against my will—just because I wouldn’t show ID. I knew I had done nothing wrong.
From the moment I was detained, I told them I had been filming in the area and that my footage would prove I hadn’t committed any crime. They refused to look at it. They didn’t care if I had broken the law or not—they just wanted my ID.
They tried to justify their actions by threatening me with charges like trespassing and failure to identify, even though I explained both the trespassing law and Texas Penal Code 38.02, which clearly states that Texas is not a “Stop and ID” state, and you cannot be arrested for failure to identify unless you’re lawfully arrested for another offense first.
When they took me to jail, the supervisor refused to process me, stating I had broken no laws. Despite this, the officer—working under instructions from a Montgomery County Assistant DA—tried to push forward, claiming I must have a warrant. I did not have a warrant.
While waiting at the jail, I told the officer that if he apologized for violating my rights, I would consider removing him from the lawsuit. He bluntly stated that he didn’t care.
After being rejected by the jail and finding no legal basis for charges—even after another call with the Assistant DA—the officer drove two blocks away from the jail and abandoned me, far from where he had unlawfully detained me.
I really need help finding a lawyer. I’m hoping that with enough exposure, someone will step forward to help me seek justice for these blatant rights violations and immoral conduct.
