I just closed on this property as the listing agent. It was an unexpected sale as the owner had suddenly fallen ill and was unable to return to his home. Just prior to listing with me, he had established a Power of Attorney with a family member. In these past 30 days while under contract, however, he declined significantly to the point that I don’t know if he would’ve been deemed competent to sign that POA had it not been done earlier. In fact, I wasn't sure he would survive to see closing. Fortunately, he has. And since the POA was in place prior to entering into the listing agreement, his loved one was able to focus just on his care. It went well, but it's not always like this.

I bring this up as a Realtor – I’m not a lawyer, and I’m not giving legal advice. If you don’t have an estate plan in place, please consider doing so. I’ve worked with many adult children of parents who got sick and transitioned, often quickly and unexpectedly, without an estate plan in place – no POA, no will, no trust, etc, nothing – and it adds an unnecessary layer of complexity, anxiety and expense for the heirs. All of this while they’re trying to grieve, figure out what to do with a home (full of stuff) they just inherited but don’t want to keep, and manage their own life and family that is often in another state.

If you want to maximize the value of your assets and minimize the expense and hardship for your heirs, estate planning can do just this. Find a reputable estate planning attorney and have them do it for you because the language used matters.
