Update:
So I spoke to the department that issued the Cease and Desist today.
They weren't terribly concerned and shared my sentiment that FB Marketplace/home based business sales were similar to my operation.

They asked if I could move my plants to my backyard which of course I replied no I could not.
(Why would I have to?)

They asked if I could remove the payment information signs from my racks. I replied no, I could not as these are my pop-up fixtures and again my personal property on my personal property.

I agreed to remove the Curbside Market signage and not advertise the Curbside Market.
(But I can and will post specific items for sale)

You can still come by anytime and look around at what we have at your convenience.
You and your friends and family are officially invited to visit my home. It's an open invitation and I can dictate who comes and goes and it's no one's business what happens on my property.

You can show up in a bunny costume and have a pop up rave in my front yard as long as I agree to it and we're adhering to noise ordinances.

We won't let the Debbie Downers squash small businesses because they're ill and bored.

The neighborhood watchdogs are busy keeping our street safe from plant sales 🙄
Not all angels have wings 👹

The sign will be coming down, the plants will stay.

Again, the address is 4337 Ray Dr Montgomery AL 36109 and it is not a commercial zoned area so we don't have a curbside market that is self serve digital pay with checkout instructions posted on the racks.
But if you message me for the address, you can do porch pickup.
And there are payment instructions posted on the racks I use for markets and set up on my porch between markets.

What a fabulous 2025 Herb Day yesterday! So great to see my planty peeps and so many phenomenal new vendors this year.
