For the Homeowner
If you agree to a contractor’s offer like “you don’t have to pay your deductible”:
* Insurance fraud charges
Many states consider this a form of fraud because the deductible is part of your legal responsibility under the policy.
* Policy cancellation or denial of claim
Your insurer can refuse to pay the claim or cancel your policy if they find out.
* Repayment (and more)
You may be required to pay back the claim amount that shouldn’t have been covered—sometimes with penalties.
* Possible criminal penalties
In more serious cases, this can mean fines or even misdemeanor/felony charges depending on the amount involved.

For the business offering to “eat” or “waive” the deductible:

This is often considered knowingly participating in fraud.
* License suspension or revocation
State licensing boards can shut down or restrict the business.
* Fines and restitution
Contractors can be ordered to pay back money and face heavy fines.
* Civil lawsuits
Insurance companies may sue for damages.
