All the text messages conveying what I wanted prior to the bid. After I signed the proposal David Brainerd met up with me to get money and I went over it all with him in more depth where I conveyed to him that I did not want my basement to leak since it was to be a liveable basement.

Bellow are pictures of the original contract, the Engineer Report from Miller Engineering, the termination request letter that BNC Builder sent and then the change orders that they sent by email after the Termination Request Letter since they didn't include it in the letter as the letter states.

This was the first time ever that anything was presented and there are blatent lies in the change orders.

after David Brainerd got his panties in a twist that same day when he was told his workers whom he sent out, were not installing the waterproofing membrane properly.

The workers were asked if they ever did this before to which they replied no but it wasn't much different than a pool.

David was texted October 19th the pictures below and informed to which he replied with a screenshot that stated the product could be applied horizontally or vertically in numerous applications. After speaking with a rep from the product company about proper installation, David was called, he argued that the product was being installed correctly until he was told that a product rep said it wasn't. The Reps name and phone number was sent to him along with a video of the proper way to install.

David had his workers remove the product and leave the property never to return and sent the following letter. Below are pictures of the letter, the way the product was being installed and screenshots of the text communication. This guy clearly doesn't know what he is doing.

We hired them last year in October of 2022 to build us a basement with a one story addition. A year later all we have is a partially built basement and they have constantly screwed up all along the way. I have had to monitor them and get on to them about doing it correctly. I have had to get an engineer involved just to prove to them that they were doing it wrong to which they then wanted to charge me to fix their mistakes. On top of that they left my existing foundation exposed as they dug out under the footer and left it like that. The engineer said to fill it with concrete and they asked if they could use structural foam. The engineer said yes and these guys purposely filled it with insulating foam that has absolutely no structural integrity at all. They don't know how to build a basement nor waterproof one properly and then they decided to just quit after a year and not fulfill their contract or refund a proper portion of the $68,000 I gave them upfront. They have caused more work that now needs to be done due to their incompetence and willful destruction of my property. I have heard I am not the only person they have screwed over so please spead the word so no one else gets scammed and screwed over by them. I was more than patient with them as this project I was told was to only take 3 months. I have gave them many chances to fix their mistakes yet now they refuse. Mind you they were only drying it in, we were to do all the electrical, plumbing, insulation, interior wall framing and finishes.
