Are you listing or marketing a property with unapproved additions, flatlets, converted garages, or enclosed lapa’s?
These must appear on approved building plans - or the property is non-compliant, regardless of disclosure or voetstoots clauses.
📌 As per the National Building Regulations (Act 103 of 1977):
✅ All building work requires municipal approval
✅ Voetstoots doesn’t protect you from liability
✅ Sellers AND agents remain legally accountable
✅ Buyers can take action even after transfer
⚠️ Agent Responsibilities (Property Practitioners Act):
As property professionals, you are bound to act with honesty, diligence, and transparency.
Failing to verify or disclose illegal structures could mean:
• Misrepresentation
• Negligence
• Breach of fiduciary duty
• PPRA disciplinary action

• Ask if all structures are approved
• Request updated plans
• Don’t list if compliance is refused - voetstoots won’t protect you
• Keep written proof of all discussions
